Agreement to Terms
Welcome to Next Level Platinum 360 Photo Booth. By accessing our website or booking our 360 photo booth services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
Service Description
Next Level Platinum 360 Photo Booth provides professional 360-degree video and photo booth services for events, weddings, parties, and celebrations. Our services include:
- 360-degree video capture platform and equipment
- Professional attendants for setup, operation, and teardown
- Digital overlays, effects, and customization options
- Instant sharing via email, SMS, QR code, and Airdrop
- Props, backdrops, and special effects as per selected package
Booking and Deposit Policy
Required Deposit
A non-refundable deposit is required with every tier to secure your booking date and time. The deposit amount will be specified during the booking process and must be paid to confirm your reservation.
Minimum Booking & Additional Hours
All packages include a 2-hour minimum service period. Additional hours beyond the minimum can be added at a rate of $100 per additional hour. Additional hours must be requested and confirmed prior to the event date.
Travel Charges
Events located more than 20 miles from our base location are subject to a $25 travel charge. This fee covers transportation costs and will be added to your final invoice. Travel distance is calculated from our business location to your event venue.
Payment Terms
The remaining balance after the deposit is due one week (7 days) prior to your event date. We accept payment via cash, credit card, and electronic transfer. Failure to pay the remaining balance may result in cancellation of services without deposit refund.
Cancellation and Refund Policy
Important: 1-Week Cancellation Window
Any cancellation within 1 week (7 days) of the event will NOT have their deposit refunded. This policy is strictly enforced due to the difficulty of rebooking services on short notice and the opportunity cost of turning away other potential clients.
Cancellation More Than 1 Week in Advance
Cancellations made more than 1 week (7 days) before your event date may be eligible for a partial refund, subject to review and approval. Refund amounts will be determined on a case-by-case basis and may be subject to administrative fees.
Rescheduling
If you need to reschedule your event, please contact us as soon as possible. Rescheduling requests made more than 2 weeks before the event date will be accommodated subject to availability, with no additional fees. Rescheduling within 2 weeks of the event may incur additional charges.
Modification of Services
Changes to your package, event location, or time must be made at least 2 weeks before your event date, subject to availability. Changes may result in additional charges depending on the nature of the modification.
Event Requirements and Client Responsibilities
Venue Requirements
The client must ensure the event venue provides:
- Adequate space for 360 photo booth setup (minimum 10ft x 10ft clear area)
- Access to standard electrical outlets (110V)
- Level, stable flooring suitable for equipment
- Reasonable access for equipment load-in and load-out
- Protection from weather elements for outdoor events
Setup and Breakdown
Our team will arrive 60-90 minutes before the event start time for setup and testing. Please ensure venue access is available during this time. Breakdown typically takes 30-45 minutes after the event concludes.
Guest Safety
The client is responsible for ensuring guests follow safety guidelines while using the 360 photo booth. Our attendants will provide instructions, but we are not liable for injuries resulting from misuse or failure to follow safety protocols.
Accurate Event Information
Clients must provide accurate event details including date, time, location, and expected guest count. Significant discrepancies may result in additional charges or inability to provide full services.
Liability and Equipment Protection
Equipment Damage
Our equipment is professional-grade and expensive. The client is responsible for any damage to equipment caused by guests or venue conditions beyond normal wear and tear. This includes but is not limited to spills, intentional damage, theft, or environmental damage.
Limitation of Liability
Next Level Platinum 360 Photo Booth shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. Our total liability shall not exceed the amount paid for the services.
Technical Issues
While we use high-quality equipment and maintain it meticulously, technical failures can occur. In the event of equipment failure, we will make every reasonable effort to repair or replace equipment promptly. If services cannot be provided due to equipment failure, liability is limited to a refund of fees paid.
Force Majeure
Next Level Platinum 360 Photo Booth shall not be held liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, severe weather, pandemic, government restrictions, strikes, labor disputes, transportation issues, or other unforeseen events. In such cases, we will work with you to reschedule the event or provide a refund of fees paid.
Content Usage and Rights
Client Content Ownership
All 360 videos and photos created at your event belong to you and your guests. You receive full rights to use, share, and distribute this content as you wish.
Portfolio and Marketing Use
By booking our services, you grant Next Level Platinum 360 Photo Booth permission to use photos and videos from your event for marketing, portfolio, and promotional purposes, including on our website and social media channels. If you wish to opt out of this, please notify us in writing before your event.
Content Delivery
Event content is delivered to guests in real-time via email, SMS, QR code, and Airdrop. We are not responsible for delivery failures due to incorrect contact information, network issues, or email/SMS provider limitations.
Content Storage
We retain event content for a limited time period as specified in your package. After this period, content may be deleted and cannot be recovered. It is your responsibility to save and back up content you wish to keep.
Code of Conduct
We reserve the right to refuse service or remove access to the 360 photo booth for any guest who:
- Engages in threatening, abusive, or harassing behavior toward our staff
- Appears to be intoxicated or under the influence of substances to a degree that poses safety concerns
- Attempts to damage or misuse equipment
- Violates venue rules or applicable laws
- Creates inappropriate or offensive content
Removal of access due to misconduct does not entitle the client to a refund or compensation.
Insurance and Permits
Next Level Platinum 360 Photo Booth carries general liability insurance for our operations. Clients are responsible for obtaining any necessary venue permits or insurance required by their event location. Some venues may require proof of insurance or additional vendor insurance, which can be provided upon request.
Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Next Level Platinum 360 Photo Booth and protected by copyright laws. You may not reproduce, distribute, or create derivative works from our website content without explicit written permission.
Dispute Resolution
Any disputes arising from these Terms of Service or our services shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The venue for arbitration shall be in the county where our business is located.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the state where our business operates, without regard to its conflict of law provisions.
Severability
If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.
Changes to Terms of Service
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.
Entire Agreement
These Terms of Service, together with our Privacy Policy and any written booking agreement, constitute the entire agreement between you and Next Level Platinum 360 Photo Booth regarding our services and supersede all prior agreements and understandings.
